1. Introduction

Welcome to Dolce By Jery. These Terms and Conditions (“Terms”) govern your use of our website at dolcebyjery.com and our ordering services. By using our site or submitting an order request, you agree to be bound by these Terms. If you do not agree, please do not use the site.

2. Order Request Process

Dolce By Jery operates on an approval-based ordering model:

  • Submitting an order request through our website does not constitute a confirmed order and does not obligate either party to complete a transaction.
  • We review all order requests based on our current availability and capacity. We reserve the right to accept or decline any request at our discretion.
  • If we accept your request, we will send you a Stripe invoice via email. Your order is only confirmed upon receipt of full payment of that invoice.
  • If we are unable to fulfill your request, we will notify you promptly by email. No charges will be made if a request is declined.

3. Pricing & Invoicing

  • All prices displayed on our website are estimated starting prices for the base cake (size, flavor, filling, and buttercream) and are listed in U.S. dollars.
  • Custom design requests (including uploaded design references, complex decorations, or special requests) may result in additional charges beyond the base price. Any additional charges will be communicated to you before a final invoice is issued.
  • Your final invoice amount will reflect the confirmed price for your specific order, including any applicable design charges.
  • Prices are subject to change. Price changes will not affect orders for which a Stripe invoice has already been issued.

4. Payment

  • Payment is processed exclusively through Stripe. We accept major credit and debit cards. No payment is collected at the time of submitting an order request.
  • Full payment of the issued Stripe invoice is required to confirm and secure your order.
  • Stripe invoices are typically due within 3 days of issuance. Unpaid invoices may result in the order slot being released.
  • We do not store your payment card information. All payment data is handled securely by Stripe in accordance with their terms and security standards.

5. Cancellations & Refunds

  • Cancellations by customer: If you need to cancel after paying your invoice, please contact us at orders@dolcebyjery.com as soon as possible. Refund eligibility depends on how far in advance you cancel and whether preparation has begun.
  • Cancellations with more than 7 days’ notice: A full refund will be issued, minus any non-recoverable ingredient or supply costs already incurred.
  • Cancellations with less than 7 days’ notice: Refunds may be partial or unavailable, as ingredients and preparation work may already be underway. We will assess each situation individually and communicate our decision promptly.
  • Cancellations by Dolce By Jery: In the unlikely event we must cancel a confirmed order, you will receive a full refund and prompt notification.

6. Custom Design Orders

  • Custom design requests are subject to our review and approval. We reserve the right to decline designs that we are unable to execute to our quality standards.
  • Design reference images you upload are used solely to fulfill your order. We may photograph completed cakes for portfolio and marketing purposes unless you request otherwise.
  • We make every effort to match custom designs accurately, but exact replication cannot be guaranteed, as each cake is handcrafted.

7. Pickup Policy

  • All orders are pickup only in NW Washington, DC. We do not offer delivery.
  • Your pickup date is confirmed at the time of order. Please arrive on time. If you are unable to pick up on your scheduled date, contact us immediately — we cannot guarantee the cake’s quality beyond the scheduled pickup window.
  • Unclaimed orders will not be eligible for refund after 24 hours past the agreed pickup time.

8. Allergens & Dietary Information

Our cakes are produced in a kitchen that handles common allergens including dairy, eggs, wheat/gluten, nuts, and soy. While we take reasonable precautions, we cannot guarantee that any product is completely free of allergens. Customers with severe allergies should contact us before placing an order.

9. Website Accuracy & Availability

We strive to maintain accurate and up-to-date content. However, we do not guarantee the completeness or accuracy of all content, including pricing and availability. We cannot guarantee uninterrupted access to the website and may suspend service for maintenance without notice.

10. Intellectual Property

All content on this website — including images, logos, text, and designs — is the property of Dolce By Jery or our licensed content providers and is protected by applicable copyright laws. No content may be copied, reproduced, or used for commercial purposes without our prior written consent.

11. Limitation of Liability

To the fullest extent permitted by law, Dolce By Jery shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability for any claim related to an order shall not exceed the amount paid for that specific order.

12. User Conduct

You agree not to use our website to:

  • Violate any applicable laws or regulations
  • Submit fraudulent or misleading order requests
  • Interfere with the website’s operations or security
  • Engage in harassment or abusive communications

13. Modifications to Terms

We reserve the right to update these Terms at any time. Changes are effective upon posting with a revised “Last Updated” date. Continued use of the site after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the District of Columbia, United States. Any disputes arising from these Terms or our services shall be resolved in the courts of Washington, DC.
